Welcome to Alfarabi Lab (referred to as “mobile app/app/website/online services/Alfarabi Lab), services provided by Obeikan Digital Solutions, a Saudi Company based inSaudi Arabia ( the Company). The mobile app is operated by the Company (referred to as "we/our/us/mobile app/website/online service/Alfarabi Lab). As a user (referred to as "you/your/ patients/clients") of the website you must read and acknowledge below the following terms and conditions (the “Terms and Conditions”).

By using the online services, you agree to be bound by the Terms and Conditions. Read carefully before using the online service. If you do not agree (or cannot comply with) any of the Terms and Conditions, do not use the online services.

Alfarabi Lab makes this app available for the sole purpose of facilitating communications between health services providers and consumers who choose to use the online service. Under NO condition Alfarabi Lab is liable for the consultancy advice of the Doctors or consultants. Alfarabi Lab Only provides a platform of communication and connects members (Patients or Clients) with registered / Certified Doctors & Consultants.

Members/Users using the Alfarabi Lab accept that any advice provided by the Doctors/Consultants are only between them and Members (Patients /Clients) and Alfarabi Lab under NO circumstances may be liable for it. Therefore, members agree that under NO condition they can take any legal action against Alfarabi Lab or any of the staff for the advice and consultancy of the Doctors/ Consultants.

YOUR USE OF ALFARABI LAB

Interaction with health services providers using ALFARABI LAB is not intended to take the place of appointments with your regular primary care provider. If you do not have an established relationship with a primary care provider, you are encouraged to develop one. Do not disregard medical advice from your regular doctor or other health professional because of information provided by a health services provider via Alfarabi Lab.

Alfarabi Lab is not licensed to practice medicine and does not render medical care or medical advice.

Neither Alfarabi Lab, nor any of its licensors or suppliers, shall be liable for any advice obtained from a health service provider using Alfarabi Lab. Alfarabi Lab does not recommend or endorse any specific providers, tests, medications, products or procedures. All services or recommendations made by a health service provider are based on their independent professional judgment.

Do not use this app for emergency medical needs, If you experience a medical emergency, call your doctor or visit hospital immediately.

INFORMATION ABOUT HEALTH SERVICE PROVIDERS

When you choose to use the Alfarabi Lab digital platform you will be provided with a list of health services providers based on the selection criteria that you provide and on provider availability. The information we make available about any particular health services provider is supplied to us by that provider, and Alfarabi Lab makes no warranty as to its accuracy. Users of the Alfarabi Lab digital platform are ultimately responsible for choosing which health services provider to communicate with.

YOUR COMMUNICATIONS

You are responsible for your own communications using Alfarabi Lab. You may not:

  1. communicate material that is copyrighted, without the permission of the copyright owner.

  2. communicate material that reveals trade secrets, unless you have permission of the owner.

  3. communicate material that infringes on any other intellectual property rights of others or on the privacy or publicity rights of others.

  4. communicate material that is obscene, defamatory, threatening, harassing, abusive, hateful, or embarrassing to any person or entity.

  5. communicate a sexually explicit image.

  6. communicate chain letters or pyramid schemes.

  7. impersonate another person; or

  8. violate the Children's Online Privacy Protection Act.

To the fullest extent permissible pursuant to applicable law, Alfarabi Lab disclaims all representations, warranties, and conditions, express or implied, including, but not limited to, implied condition or warranties of merchantability and fitness for a particular purpose. Alfarabi Lab does not warrant that the Websites and Platforms will be uninterrupted or error-free, that defects will be corrected or that the Websites and Platforms or the server that makes it available are free of viruses or other harmful components.

Alfarabi Lab makes no guarantees and disclaims any implied warranty or representation about its accuracy, relevance, timeliness, completeness, or appropriateness of any content posted on the Website and Platforms for a particular purpose. Alfarabi Lab assumes no liability arising from or relating to the delay, failure, interruption, or corruption of any data or other information transmitted in connection with use of the Websites and/or Platforms.

A virtual consultation is an alternative method of providing care to patients that efficiently respond to routine, non-complex medical problems.

The virtual consultations and care provided, in no shape or form is a substitute for actual medical intervention whose nature might be complex and should not be utilized for complex, non-routine or emergency medical care. In the event of such a situation, the patient must immediately consult the nearest available medical care provider.

Alfarabi Lab App Requires location permission to enableBluetoothDevices to be connected to the application even when the app is in use. No location data is collected or shared with any third party. Alfarabi Lab does not track your location neither saves location data.

ACCOUNT

Your account is associated with your mobile number and is verified via an OTP sent to your mobile device; this will allow you to access the Alfarabi Lab digital platform. You are solely responsible for safeguarding your mobile device and are prohibited from making available your mobile device to any third party. You agree to notify Alfarabi Lab Customer Support or Admin at info@alfarabilabs.com immediately of any unauthorized use of your mobile device or of any need to reset or lock down the account.

Privacy Policy

We view protection of your privacy as a very important community principle. We understand clearly that you and your information is one of our most important assets. We store and process your information on our servers that are protected by physical as well as technological security devices. We use third parties to verify and certify our privacy principles. If you object to your information being transferred or used in any way, please forward your request to the Company or deem not to use the website.

We do not sell or rent your information to any third parties without your explicit consent.

Registration includes the information (your information) that you need to provide us to deal with us and also to contact you. We also collect information about the consultations you make, insurance data and prescription data. You agree that we may use (and update) your information to manage your registration and to control your identity during the use of our online services.

The details provided by you during registration will be protected in accordance with our Privacy Policy. Your information will form part of a record of your dealings with us. If you use online services, you are responsible for maintaining the confidentiality of your account and for restricting access to your phone/computer, and you agree to accept responsibility for all activities that occur under your account.

The online services assume no liability to any person for any loss or damage which may arise as a result of any failure by you in protecting your account. Any suspicious activities on your account shall be notified by contacting us immediately through contacting us. Click on “Contact Us” within the mobile app.

Electronic Communication

As you use online services and communicate with us electronically, you also consent to receive communications from us electronically, by means of emails, newsletter or by posting notices such as disclosures on the website/mobile app. You agree that any communication that we provide to you electronically satisfy any legal requirement, as in writing.

We may monitor, record, store and use any telephone, email or other electronic communications with your information for training purposes, to check instructions given to us and to improve the quality of our patient services.

TERMINATION

Alfarabi Lab may terminate any user's right to use this app at any time. Alfarabi Lab reserves the right to block, delete or stop the uploading of materials and communications that it in its sole discretion finds unacceptable for any reason. If your right to use this app ends, you shall make no further use of this app or any information obtained from this app. If you find that you have been terminated, you may contact Alfarabi Lab Customer Support at info@alfarabilabs.com for further information.

LINKING TO OTHER APPS/SITES

From time to time we will provide links to other apps/websites, not owned, or controlled by Alfarabi Lab. We do this because we think this information might be of interest or use to you or where, as a user, we can provide you with value-added services. While we do our best to ensure your privacy, we cannot be responsible for the privacy practices of other apps/sites. A link to a non-Alfarabi Lab app/website does not constitute or imply endorsement by Alfarabi Lab.

Additionally, we cannot guarantee the quality or accuracy of information presented on non- Alfarabi Lab apps/websites. We encourage you to review the privacy practices of any app/website you visit.

APPROPRIATENESS OF CONTENT

This app is not intended to attract children under the age of 18. Children under 18 must be enrolled on the app under their parent or guardian’s account as a dependent. Parents or guardians are solely responsible for being present with their minors when using the Alfarabi Lab app.

Alfarabi Lab reserves complete and sole discretion with respect to the operation of Alfarabi Lab. Alfarabi Lab may withdraw, suspend or discontinue any functionality or feature of the services. Alfarabi Lab is responsible for maintaining data arising from use of the services, but does not warrant the accuracy or completeness of the data stored. Alfarabi Lab reserves the right to maintain, delete or destroy all communications and materials posted or uploaded to the Alfarabi Lab system pursuant to its internal record retention and/or destruction policies.

INTELLECTUAL PROPERTY

All of the content available on or through Alfarabi Lab app/website is the property of Alfarabi Lab or their licensors, and is protected by copyright, trademark, patent, trade secret and other intellectual property laws. We give you permission to display, download, store and print the content only for your personal, non-commercial use. You agree not to reproduce, retransmit, distribute, disseminate, sell, publish, broadcast, or circulate the content received using the Alfarabi Lab digital platform to anyone. All software and accompanying documentation made available for download from the Alfarabi Lab app/website is the copyrighted work of Alfarabi Lab or its licensors. Subject to these terms and the Alfarabi Lab User Agreement, Alfarabi Lab hereby grants you a limited, revocable, non-transferable and non-exclusive license to use the software, network facilities, content and documentation on and in the Alfarabi Lab app/website to the extent, and only to the extent, necessary to access and use the Alfarabi Lab digital platform for your personal use.

Alfarabi Lab AND ITS LICENSORS AND SUPPLIERS (INCLUDING, FOR THE PURPOSES OF THIS ENTIRE SECTION, ALL PROVIDERS OF CONTENT FOR THIS APP/WEBSITE) SHALL NOT BE LIABLE TO YOU, UNDER ANY CIRCUMSTANCES OR UNDER ANY THEORY OF LIABILITY OR INDEMNITY, FOR ANY DAMAGES OR PENALTIES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, INCIDENTAL INDIRECT, EXEMPLARY, PUNITIVE AND CONSEQUENTIAL DAMAGES, LOST PROFITS, OR DAMAGES RESULTING FROM LOST DATA OR BUSINESS INTERRUPTION) IN CONNECTION WITH THE USE OR INABILITY TO USE THIS APP/SITE OR THE CONTENT, EVEN IF ANY OF THEM HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Alfarabi Lab and its licensors and suppliers are not responsible for any claims you may have against any medical professionals, suppliers of products or other persons, institutions or entities identified in whole or in part through this app/website.

No Warranties. THE APP/SITE, SERVICES, CONTENT AND INFORMATION ARE PROVIDED "AS IS." Alfarabi Lab, ITS LICENSORS AND SUPPLIERS DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, NONINFRINGEMENT OF THIRD PARTIES RIGHTS OR FITNESS FOR A PARTICULAR PURPOSE.

INDEMNIFICATION

You shall not settle any such claim without the written consent of the applicable Indemnified Party.

BY USING THIS APP, YOU PROVIDE CONSENT AND AGREES NOT TO TAKE ANY LEGAL ACTION AGAINST Alfarabi Lab, ITS DIRECTORS, PARTNERS OR STAFF FOR ANYTHING. THIS IS YOUR RESPONSIBILITY THAT YOU UNDERSTAND AND RE-CHECK WHERE YOU BELIEVE THAT MEDICAL ADVICE OR CONSULTANCY MAY NOT BE CORRECT.
